A tragic truck accident that claimed the lives of a mother and daughter and inflicted serious personal injuries on four others is being blamed on the "gross negligence" of a West Sacramento California truck driver. According to reports, the California trucker has been charged with two counts of vehicular homicide after his semi tractor-trailer veered across the median into the path of two oncoming cars. It is unknown what caused the big-rig driver to lose control of the truck and drive into the path of a Dodge Charger carrying the mother and daughter, and a Chevy Trailblazer.
The accident remains under investigation, with officials stating "There's more to it than it just being an accident. We're doing some other investigation on a couple of different things."
If you or a loved one has been involved in a Elk Grove truck accident, it is important to consult with a knowledgeable Elk Grove truck accident lawyer right away. Often many factors are involved in any one accident and it is important that you have a skilled California personal injury attorney on your side.
Many times, serious motor vehicle crashes may involve at least two separate legal proceedings. For example, where some sort of criminal activity is suspected, a District Attorney may become involved and filed criminal negligence charges. Additionally, where personal injuries or a wrongful death occurs, an individual or the surviving family members may file a civil negligence lawsuit to recover compensation including medical expenses, lost wages, pain and suffering and even punitive damages.
Here, several questions remain. For example, the driver claims he was driving for the South Carolina trucking company - DC Transport. However, the West Sacramento operations manager for the trucking company asserts that they did not employ the driver and that they were not involved in the accident. Often a trucking company may be found to be responsible in truck accidents causing personal injury where they fail to properly maintain their big rigs, employ drivers without adequately checking their background or if they violate other trucking laws.
An initial investigation of the trucking company showed that DC Transport vehicles had been placed out of service after federal authorities discovers violations in 24 out of 77 inspections. This translates into a 31.2% violation rate, well above the national average. Further, DC Transport company drivers were also placed out of service after the drivers also had more violations than the national average. These included violations for unsafe driving.
How the West Sacramento driver came to be driving the truck and how much the trucking company was involved will be subject to continued investigation.
